FLSA Compliance

JFK Consulting offers comprehensive services that assess and review all compensation plans and communication materials to ensure compliance with the Fair Labor Standards Act which was recently updated by the Department of Labor to reflect a more contemporary work environment.

On August 23,2004 new rules governing overtime eligibility for “white-collar” workers under the Fair Labor Standards Act took effect. These new rules are the first significant changes to the FLSA in nearly a half century; most notably, they seek to update rules regarding which employees are eligible for overtime pay. Let us help explain the new changes and provide the necessary resources to help you understand what effect these new rules will have on your company. These new rules clearly define what the specific requirements are for exemption from overtime for the following job categories:

  • Executive - management is the employee's primary duty
  • Administrative - employee performing non-manual office work
  • Professional/creative - employee whose work requires highly advanced knowledge/education; creative and artistic professional
  • Computer professional - employee involved in design or application of computers and related systems
  • Outside sales - employee making sales or taking orders which influence sales outside of the employer's premises

JFK Consulting has the experience and knowledge to interpret these new regulations to protect your company and ensure you are in compliance. We can assist you by developing a questionnaire to audit all your positions, interview and conduct desk audits for all affected employees, develop communications for explaining the law to the employees, and other related activities.
